Product Legal Policy & Liability Disclaimer

This Product Legal Policy (“Policy”) applies to all products sold, distributed, or made available through PepperSprayWarehouse.com and any affiliated sales channels (“Products”). By purchasing, possessing, or using any Product, you agree to be bound by this Policy in addition to our Terms of Service.

1. Assumption of Risk – “Use at Your Own Risk”

All self-defense products, including pepper spray, tear gas alternatives, mace, personal alarms, and related devices (“Self-Defense Products”), are inherently hazardous if misused, mishandled, or used in inappropriate circumstances.

By purchasing or using any Product, you expressly acknowledge and agree that:

  • You are using the Product entirely at your own risk
  • You voluntarily assume all risks of injury, harm, loss, or damage
  • You understand that deployment of Self-Defense Products may result in bodily injury, respiratory distress, eye injury, permanent injury, or death in extreme cases
  • You accept full responsibility for safe handling, storage, transport, and lawful use

2. No Warranty – Disclaimer of Fitness for a Particular Purpose

To the fullest extent permitted by law:

  • All Products are sold “AS IS” and “AS AVAILABLE”
  • We make no warranties, express or implied, including but not limited to:
    • Merchantability
    • Fitness for a particular purpose
    • Effectiveness in any self-defense scenario
    • Performance under real-world conditions
    • Compatibility with any specific use case

We do not guarantee that any Product will:

  • Stop an attacker
  • Function in all environmental conditions
  • Provide personal safety or protection in any circumstance

You acknowledge that Self-Defense Products are deterrents only, and outcomes depend on numerous unpredictable factors.

3. Limitation of Liability (Critical Provision)

To the maximum extent permitted by law:

Form America LLC (PS Pepper Spray Warehouse), its owners, officers, employees, contractors, affiliates, and suppliers shall not be liable for any:

  • Direct, indirect, incidental, special, punitive, or consequential damages
  • Personal injury, bodily harm, emotional distress, or death
  • Property damage or loss
  • Legal claims arising from possession or use of any Product
  • Claims arising from misuse, accidental discharge, or unlawful use
  • Claims arising from third-party actions

STRICT LIABILITY CAP

In all circumstances, our total liability for any claim related to any Product shall be strictly limited to:

The replacement value of the specific Product purchased from us giving rise to the claim.

If replacement is not available, our maximum liability shall not exceed the purchase price paid for the Product.

This limitation applies regardless of:

  • Theory of liability (contract, tort, negligence, strict liability, etc.)
  • Whether we were advised of the possibility of damages

4. No Liability for Misuse or Illegal Use

We are not responsible for any use of Products that is:

  • Unlawful under federal, state, or local law
  • Used in an offensive, criminal, or non-defensive manner
  • Used by an unqualified, underage, or prohibited individual
  • Used while impaired by drugs or alcohol

Any misuse voids any implied responsibility or liability on our part.

5. Product Handling, Storage & User Responsibility

You agree that you are solely responsible for:

  • Safe storage of all Products away from children and unauthorized users
  • Preventing accidental discharge or exposure
  • Understanding product instructions and warnings
  • Compliance with all applicable laws regarding possession and transport

Failure to follow safety instructions releases us from any liability.

6. Regulatory Compliance Responsibility

Self-defense product laws vary by jurisdiction.

By purchasing, you certify that:

  • You are legally allowed to purchase and possess the Product
  • You are responsible for verifying legality in your jurisdiction
  • You will not transport or carry Products into restricted areas

We assume no responsibility for confiscation, fines, or legal penalties.

7. No Guarantee of Self-Defense Effectiveness

You acknowledge and agree that:

  • No self-defense product is guaranteed to stop or deter an attacker
  • Human factors (adrenaline, intoxication, clothing, wind conditions, distance, accuracy, and timing) may affect performance
  • Products may fail, malfunction, or be ineffective in certain situations

We make no representations regarding survival, safety outcomes, or defensive success.

8. Product Information Disclaimer

All product descriptions, videos, marketing materials, and instructions are provided for general informational purposes only.

We do not guarantee:

  • Accuracy or completeness of descriptions
  • That instructions are sufficient for all users or conditions
  • That product performance will match marketing examples

9. Indemnification

You agree to indemnify, defend, and hold harmless Form America LLC, PS Pepper Spray Warehouse, and its affiliates from any and all claims, liabilities, damages, losses, or expenses (including attorney’s fees) arising from:

  • Your purchase, possession, or use of Products
  • Your violation of this Policy or applicable law
  • Claims brought by third parties related to your use of Products

10. Product Modifications & Tampering

We are not responsible for any Product that has been:

  • Altered
  • Refilled
  • Disassembled
  • Tampered with
  • Improperly stored or maintained

Any such modification voids any responsibility or liability.

11. Severability

If any provision of this Policy is found unenforceable, the remaining provisions shall remain in full force and effect.

12. Entire Agreement

This Policy, together with our Terms of Service and Privacy Policy, constitutes the entire agreement governing Product use and supersedes all prior representations.

13. Acknowledgment of Agreement

By purchasing or using any Product from Pepper Spray Warehouse, you acknowledge that:

  • You have read and understood this Policy
  • You agree to be bound by its terms
  • You voluntarily assume all risks associated with Product use
  • You accept the limitation of liability and no-warranty provisions
