For years, New York has had some of the most restrictive pepper spray purchasing laws in the country. While residents in most states can order pepper spray online and have it shipped directly to their homes, New Yorkers have generally been required to purchase compliant self-defense spray devices in person from licensed firearms dealers or authorized pharmacies. That may soon change.
The New York Legislature has passed legislation that would modernize the state's pepper spray laws by removing the long-standing restriction limiting sales to firearms dealers and pharmacies. The bill would also establish updated statewide standards, maintain age and eligibility requirements, and continue to limit purchases to two self-defense spray devices per transaction. The legislation is now awaiting action by Governor Kathy Hochul. Until the Governor signs the bill and it takes effect, current New York law remains in force, and online sales to New York residential addresses are not yet authorized. We think she will sign it in July.
If signed into law, this legislation could represent one of the biggest changes to New York's pepper spray laws in decades.
